Phillip Morris snuffs out sales of MP-23 Exhaust in the US

There's been a bump in the road for American Transformers fans hoping to get their hands on Takara Tomy's MP-23 Exhaust figure. The Japanese figure intended for the Japanese market is patterned off of a real-life Lancia Series 5 Stratos race car with Marlboro cigarette markings from the 1970s which also received a figure in Takara's Diaclone line back in the day. While this is all fine and good in Japan and the new Exhaust figure doesn't explicitly say Marlboro on it it does still use the red and white cigarette box design down its length. This has raised concerns with Phillip Morris USA, owner of the Marlboro brand.

Now, normally you would think this was a case Phillip Morris trying to protect its own image since the design certainly wouldn't be licensed for use in the US being a Japanese figure. However, it's not that simple. It's not entirely a matter of PM not wanting to see the figure released in the US, but rather than that they legally can't allow it. You see, back in the late '90s as tension grew over accusation that cigarette manufacturers were targeting children, two standing rules were put in place to prevent cigarette markings from appearing on toys sold in the USA.

First is the Tobacco Master Settlement Agreement which states that cigarette manufacturers must not "take any action, directly or indirectly, to target Youth within any Settling State in the advertising, promotion or marketing of Tobacco Products, or take any action the primary purpose of which is to initiate, maintain or increase the incidence of Youth smoking within any Settling State." Then there's the Family Smoking Prevention and Tobacco Control Act which, among other things, requires marketing to go through the FDA first and limits advertising that could be used to attract youths. In other words no selling Transformers in the USA painted up like cigarette boxes that could potentially find their way into children's hands since, you know, all toys are for kids. 

So far this is only effecting toys being sold within the US and doesn't appear to prohibit the importing of the figure from outside to the USA or sales in other parts of the world. After the jump you can read Big Bad Toy Store's statement on the situation after they received a notice from a law firm representing Phillip Morris USA. I'm just glad I import all of my Japanese Transformers.

He went to an event in New Jersey where they had a drag race between the 1966 Batmobile TV Car and the Monkeemobile! Oh yeah, and that's our buddy Benjy dressed-up as the Penguin, waak waak waak!

Here's a quick post to share this cool photo from a BAT-BLOG FACEBOOK Friend named Terry. This is a very High Quality, Custom Made, Hand-Built, Hungarian , Hi-Gain ELECTRIC AMP by KAOS. Very nice stuff!

These are made by a Hungarian company. They have a couple of production model amps, but their custom shop allows customers to choose their own face plates. Someone obviously chose wisely.

Here's some great news for our friends living in, or near, Bulgaria!! DC Comics is publishing a "Batman: The Brave and The Bold" TV Cartoon Magazine for children. it's called, "BATMAN KIDS" and is ON the stands right now!

I love that it's in the Bulgarian language and that country finally has some new bat-product there, very cool! Let's hope it does well and it might spawn more bat-merchandise there.

The 1st Wave consists of Batman, the Joker, Harley Quinn, Poison Ivy, and Killer Croc.  Each figure stands about 3 3/4 inches tall and are scheduled to be in stores very very soon, if not right now.
